Terms and Conditions
Last updated: 19 October 2026
1. About these terms
These terms apply to the Virtus Education website and the homeschool support services and learning materials provided by Virtus Education (Pty) Ltd. “Virtus”, “we” and “us” refer to Virtus Education (Pty) Ltd.
By using this website or enrolling in a service, you agree to these terms and to any additional written terms shown during enrolment. If those terms conflict, the service-specific written terms apply to that service.
2. Our services
Virtus Education provides an annual CAPS-aligned homeschool programme for Grades R to 9. The selected package may include subject materials, assessments, marking, learner support and report cards as described in the quote, schedule of fees and enrolment information.
Virtus is a homeschool support service. We do not act as a government education authority, provide legal advice, diagnose or treat medical conditions, or guarantee that an education authority will approve an application or that a learner will achieve a particular academic result.
3. Parent and guardian responsibilities
A parent or legal guardian should make enrolment and payment decisions for a learner under 18 and is responsible for the learner’s use of the materials. Provide a suitable learning environment and reasonable access to a device and internet connection.
You are responsible for supervising the learner’s progress, ensuring assessments are completed honestly and by the stated deadlines, keeping contact and billing details current, and providing accurate enrolment information. Confirm the home-education and registration requirements that apply where you live.
4. Fees and enrolment
The quote and schedule of fees for an enrolment set the Annual Fee. The fee may be paid upfront or, where offered, in twelve equal monthly instalments by debit order, EFT or recurring card. Instalments are payable on or before the first day of each calendar month. Fees are quoted in South African Rand and are inclusive of VAT where applicable.
Choosing instalments does not change the total Annual Fee. After the cooling-off period described below, the full Annual Fee remains due even if a learner stops using the programme or access is suspended. Access may be suspended when an instalment is more than 14 days overdue.
5. Cancellations and refunds
You may cancel within five business days after registration without penalty, provided no learning materials have been issued. This cooling-off provision is subject to applicable consumer law and should be confirmed for your circumstances before enrolment.
After the cooling-off period, the Annual Fee remains payable in full and is non-refundable, except where Virtus Education materially fails to deliver the programme. This applies even if you withdraw, suspend participation or do not use the programme. Cancellation requests must be made in writing to info@virtus.org.za.
Nothing in these terms removes consumer rights or remedies that cannot legally be excluded. If these website terms conflict with a signed enrolment agreement or a quote for your enrolment, the written enrolment terms govern that enrolment.
6. Use of learning materials
Unless a written enrolment term says otherwise, learning materials are provided for personal home-education use by the learner or learners enrolled by the purchasing family. You may not sell, publish, distribute, share outside that family, or commercially reuse the materials without written permission.
Virtus Education and its licensors retain rights in the website, brand, learning materials and other content. These terms do not transfer ownership of that content to you.
7. Acceptable use of the website
Use the website lawfully and do not attempt to disrupt its operation, access accounts or data without permission, upload malicious code, or copy website content in a way that infringes another person’s rights.
We may restrict access where reasonably necessary to protect the website, other users, or Virtus Education from misuse or security risks.
8. Information, cookies and Google Ads
Information submitted through the contact form or newsletter signup is used to respond to enquiries and manage the requested communications or registration interest. Do not include sensitive personal or medical information in a general website form.
Essential storage is used for core site functions. Optional Google Ads cookies and conversion tracking remain off unless you allow cookies. If enabled, the Google tag may read or write advertising cookies and share online identifiers, browser or device details, page information, and conversion events such as page views, contact submissions or Get Started clicks with Google to measure advertising. The text of a contact message is not included in those conversion events.
Virtus Education handles parent and learner information for enrolment, programme delivery, assessment, communication and billing, in accordance with applicable privacy law, including POPIA where it applies. Information may be shared with service providers where needed to deliver the service or where required by law. You may request access to or correction of your personal information.
You can change your cookie choice using Cookie settings in the footer. Google processes advertising information under its own policies.
9. Availability and changes
We aim to keep the website and services available, but access may be interrupted for maintenance, technical issues, or circumstances outside our control. Website information may be updated, and a specific service may change; we will communicate material changes that affect an existing enrolment through the contact details on record where practical.
10. Education information and outcomes
Guides and learning materials are provided for general homeschool support. Families remain responsible for deciding how materials are used and for seeking qualified professional advice where needed. Individual learner outcomes vary, and no particular academic, registration or administrative result is guaranteed.
11. Liability
To the extent permitted by applicable law, Virtus Education’s liability under an enrolment agreement is limited to the fees paid by the parent or guardian in the twelve months before the event giving rise to the claim. Virtus Education is not liable for indirect, consequential or special damages.
Nothing in these terms excludes liability or limits consumer rights where the law does not permit that exclusion or limitation.
12. Applicable law
For South African enrolments, the agreement is governed by the laws of the Republic of South Africa, and the parties consent to the jurisdiction of the Magistrates Court. These website terms are also intended for users in the United States, where applicable federal and state laws and mandatory consumer protections may apply. A US state-specific governing-law clause and court venue have not been specified and should be confirmed by qualified counsel.
